Terms of Service

These Terms of Service (“Terms”) govern your access to and use of foxish.ai and the Foxish AI visibility platform (the “Service”) operated by Foxish (“Foxish,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility and accounts

You must be at least 16 years old to use the Service. By using the Service, you represent that you are creating the account on behalf of yourself or an organization you are authorized to bind, and that the information you provide is accurate and up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

2. Description of the Service

Foxish monitors how AI models (including ChatGPT, Claude, Gemini, Perplexity, and Google AI Overview) describe and recommend brands. The Service runs prompts against AI models on your behalf, analyzes the responses, scores visibility, and generates recommendations. The Service may also crawl publicly-accessible web pages you specify in order to produce technical analyses.

3. Subscription, free trial, and billing

  • Free trial. Paid plans include a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, your plan converts to a paid subscription and your payment method will be charged at the rate displayed when you signed up.
  • Billing. Subscriptions renew automatically each billing period until you cancel. You can cancel at any time from your billing settings or by emailing us; cancellation takes effect at the end of the current billing period.
  • Refunds. Subscription fees are non-refundable except where required by law. We may, at our discretion, offer partial refunds in exceptional circumstances.
  • Taxes. Prices shown are exclusive of taxes. You are responsible for any applicable sales, use, VAT, or similar taxes.
  • Price changes. We may change subscription prices with at least 30 days’ notice. Changes take effect at the start of your next billing period.

4. Acceptable use

You agree not to:

  • Use the Service to violate any law, infringe intellectual property rights, or harm minors.
  • Submit prompts or content designed to extract, reveal, or generate harmful, abusive, deceptive, or illegal output from AI models.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Scrape, mirror, or resell the Service’s data or interface, except where expressly permitted by your plan (for example, the Agency plan includes white-label client reporting).
  • Use the Service to monitor or analyze websites you do not own or do not have a legitimate business reason to analyze.
  • Interfere with the Service, attempt to gain unauthorized access, or use the Service to transmit malware or spam.
  • Exceed any usage limits or rate limits associated with your plan.

We may suspend or terminate accounts that violate these rules.

5. Your content

You retain ownership of the prompts, brand information, website URLs, and other content you submit to the Service (“Your Content”). You grant Foxish a worldwide, non-exclusive license to use Your Content solely to operate, improve, and provide the Service to you. You represent that you have the rights necessary to submit Your Content and to authorize Foxish to analyze the websites and brands you specify.

6. AI-generated outputs

The Service generates outputs by sending prompts to third-party AI models (OpenAI, Anthropic, Google, Perplexity) and analyzing their responses. AI outputs can be inaccurate, incomplete, biased, or misleading. You are responsible for evaluating outputs before relying on them. Foxish does not guarantee the accuracy, completeness, or fitness for purpose of any AI output and is not liable for decisions you make based on them.

Outputs you receive from the Service may be used for your own internal business purposes and, where your plan permits, shared with your clients. You are responsible for compliance with the terms of any underlying AI provider where applicable.

7. Intellectual property

The Service, including the software, design, scoring methodology, recommendations engine, and all related content, is the property of Foxish and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your subscription is active and in compliance with these Terms. No other rights are granted by implication.

8. Third-party services

The Service depends on third-party providers including Supabase, Stripe, Vercel, Resend, Meta, and AI model providers. We are not responsible for outages, data losses, or changes caused by third parties. Your use of third-party services through the Service is also subject to those providers’ terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOXISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. FOXISH’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold Foxish harmless from any claim, demand, damage, or expense (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that creates risk for us or other users. Sections that by their nature should survive termination (including IP, disclaimers, limitations of liability, and indemnification) will survive.

13. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance.
